Notes:
  • Text from Betty M. Pierce of Brownwood, TX by way of Marian Windham of Baird, TX:
    In 1830,
Robert Monteith lived in Rhea County, TN (He was a river freighter on the Mississippi River), but in April 1838, Mary and the children moved to Nacogdoches, TX (Robert supposedly died shortly after the move to Texas - I have another account that shows he never made the trip-Jim D.), and a year later applied for land grants in Angelina Co. -- 640 acres for Mary as head of the household and 320 apiece for each of the boys 17 or older, Jesse, Daniel and John. The grants were made unconditional Sep. 28, 1841, meaning they were still in possession of the land. It was the aim of the laws in the Republic of Texas to create a state of freeholders, and in support of that goal, the homestead legislation of 1838 provided that homesteads could not be seized for debt. This did not guarantee wealth for all, however, since speculators and men of wealth often claimed the river bottoms, river crossings and other choice sites before lands were open to settlers. Much of the land acquired by the Monteith family and relatives before 1860 appears to have been valued at about $1 an acre.

  • Mary and her family are listed in the census after J. D. Windham and his family. Her daughter, Frances, was married to J. D.
